These Terms and Conditions apply to all visitors, users, and clients (collectively, "Clients") who access the Website or purchase or use Services from Train With Molly.

2. Services offered by Train With Molly include personal training, fitness coaching, nutrition coaching, and related services, such as: Online coaching programs, Mobile personal training services, in-Gym personal training services, and One-off training programs. Additionally, we provide nutrition plans and coaching. All Services are offered for educational and lifestyle purposes only. No Service is intended to diagnose, treat, cure, or prevent any disease. Services are not a substitute for professional medical advice, diagnosis, or treatment.

3. No Medical Advice: All information provided through Train With Molly, including but not limited to the website, programs, materials, or coaching services, is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment by a qualified health care provider.

4. Intellectual Property: All content available on this website and within coaching materials, including but not limited to:  Training programs, Nutrition plans, Written guides, Graphics, Videos, Branding, is the exclusive intellectual property of Train With Molly and is protected under the Copyright Act 1968 (Cth) and other applicable Australian intellectual property laws. No content or materials may be copied, reproduced, distributed, transmitted, displayed, published, or otherwise used for any commercial or non-commercial purpose without the prior written consent of Train With Molly.

5. Limitation of Liability: To the fullest extent permitted by Australian law, Train With Molly, its employees, contractors, and representatives are not liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any injury, loss, or claim arising from or in connection with the use of the Website, Services, or any content provided, regardless of the basis of the claim, even if advised of the possibility of such damages. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (ACL) or any other applicable law that cannot be excluded, restricted or modified by agreement. Users acknowledge and agree that participation in any exercise, nutrition, or coaching program is voluntary and at their own risk. Users assume full responsibility for any risks, injuries, or damages, known or unknown, arising from their participation.

Accuracy of Information: While Train With Molly endeavours to provide accurate and current information on this website, we make no warranties or representations as to the completeness, accuracy, reliability, suitability, or availability with respect to the Website or the information, products, Services, or related graphics contained on the Website for any purpose. Any reliance you place on such information is strictly at your own risk. Train With Molly reserves the right to update, modify, or remove information or content on the Website at any time without notice.

7. Changes to Terms: Train With Molly may vary these Terms and Conditions from time to time. Any changes will be published on the Website. By continuing to use the Website or Services after changes are posted, you agree to be bound by the updated Terms and Conditions.

PRIVACY POLICY (AUSTRALIA)

1. Collection of Personal Information: Train With Molly may collect personal information from you, including but not limited to:

- Name  

- Email address

- Phone number

- Health or fitness information

- Payment information  

This information is collected when you complete forms, contact us, or purchase our services.

2. Purpose of Collection and Use: We collect, hold, use and disclose personal information for the following purposes:  Providing coaching services to you, communicating with you, processing payments, managing your programs, and improving our services

3. Storage and Security of Information We take reasonable steps to ensure your personal information is securely stored and protected from misuse, interference, loss, unauthorised access, modification or disclosure, in accordance with the Privacy Act 1988 (Cth).

4. Disclosure of Personal Information: We do not sell your personal information. We will not disclose your personal information to third parties except where required by law, or where necessary to provide our services (such as to payment processors, contractors, or IT providers).

5. Access to and Correction of Personal Information: You may request access to the personal information we hold about you, or request corrections, by contacting Train With Molly using the contact details provided on our website. We will respond to your request in accordance with the Privacy Act 1988 (Cth).

REFUND POLICY (AUSTRALIA)

Due to the personalised nature of our coaching services and the time invested in preparing customised programs and plans, the following refund policy applies: 1. Programs and Nutrition Plans: Once a personalised training program or nutrition plan has been delivered, it is considered fulfilled, and no refunds will be issued.

2. Change of Mind: Refunds are not provided for a change of mind.

3. Lack of Results: Results depend on individual effort, consistency, and adherence to recommendations. Refunds will not be issued for perceived lack of results.

4. Ongoing Coaching: If you wish to discontinue ongoing coaching services, you must provide notice before the next payment cycle. No partial refunds will be provided for any unused portion of a coaching period that has already commenced. This policy operates in accordance with your rights under the Australian Consumer Law. Nothing in this policy excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (ACL) or any other applicable law that cannot be excluded, restricted, or modified by agreement

CANCELLATION POLICY (AUSTRALIA)

This policy applies to all in-person training sessions conducted by Train With Molly.

1. Notice Period: You must provide at least 24 hours’ notice to cancel or reschedule a training session.

2. Late Cancellations: Sessions cancelled with less than 24 hours’ notice may be forfeited and will not be eligible for a refund or credit

3. No-Shows Failure to attend a scheduled session without providing notice may result in the loss of that session with no refund or credit provided.

4. Session Packages: Session packages are non-refundable but may be used within the validity period specified at the time of purchase. Unused sessions after this period will be forfeited. This policy is in accordance with your rights under the Australian Consumer Law. Nothing in this policy excludes, restricts, or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (ACL) or any other applicable law that cannot be excluded, restricted or modified by agreement.

MEDICAL DISCLAIMER (AUSTRALIA)

All coaching services provided by Train With Molly are intended solely for general health, fitness, and educational purposes. Train With Molly does not provide medical advice, diagnosis, or treatment. Information provided through our services is not a substitute for advice from a qualified healthcare professional. Clients acknowledge and agree that exercise and physical activity carry inherent risks.  Participation in any program or session is voluntary and at their own risk.  Clients are responsible for monitoring their own health and well-being at all times. Clients should seek medical clearance from a qualified health practitioner before commencing any exercise or nutrition program, especially if they have any existing medical conditions, injuries, or health concerns. Nothing in this disclaimer excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (ACL) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
